Terms of Service

These terms cover the FlexHealth website, the early access programme, and the FlexHealth apps. They are deliberately short.

The important one: FlexHealth is not medical care

FlexHealth is a personal tracking and understanding tool. It is not a medical device. It does not diagnose, treat, cure or prevent any condition, and it is not a substitute for a doctor, a pharmacist, a dietitian or any other qualified healthcare professional.

The application can generate AI explanations of health information you enter. Those explanations are there to help you understand your own numbers and ask better questions. They are not medical advice, they can be wrong, and they must never be the basis for starting, stopping or changing any treatment. Where an analysis gets something wrong you can correct it and have it reasoned again, but a corrected answer is still not medical advice.

If something in your results concerns you, speak to a clinician. If you think you are having a medical emergency, contact emergency services immediately - do not consult an app.

Early access

FlexHealth is early software. Signing up adds you to a list; it does not guarantee a place, a timeline, or any particular feature. Features may change or be removed. Things may break. That is the nature of a beta, and we would rather say so plainly than pretend otherwise.

Early access is currently free. If that changes, you will be told before you are ever asked for anything.

Your account and your data

If you receive access, you are responsible for keeping your login details to yourself, and for the accuracy of the information you enter. You keep ownership of everything you put into FlexHealth. How we handle your information is set out in our Privacy Policy.

Where your data lives, and what that makes you responsible for

The FlexHealth app records to your device first. Backup to our server is opt-in and off by default, which has a consequence worth stating in plain terms:

While backup is off, you are the only backup. If the device is lost, damaged, wiped, or the app is removed, that data is gone and we cannot recover it, because we never had a copy. That is the design working as intended, not a fault, and we are not liable for data lost that way.

If you switch backup on, we will keep what is uploaded and restore it when you sign in elsewhere. We will make a reasonable effort to keep it safe, but this is early software and you should not treat it as your only copy of anything that matters.

AI analysis runs on your own account

FlexHealth does not resell AI. You supply your own API key for the provider you choose, so analyses run against your account with that provider, under their terms and at their prices.

That means a few things are outside our control and outside these terms:

  • Cost. Any charges your provider bills for the analyses you run are between you and them. Keep an eye on your own usage.
  • Their terms. How that provider handles, retains or learns from what you send is governed by their agreement with you, not ours. Read it.
  • Availability and output. If the provider is down, rate-limits you, changes a model or returns something wrong, we are not responsible for that, though we will try to fail gracefully.

Running an analysis sends the records being analysed off your device. That happens only when you ask for it, you are told which provider will receive them beforehand, and it happens whether or not backup is switched on.

Acceptable use

Do not use this site or the application to break the law, to attack or disrupt the service, or to access anybody else's data. We may suspend access if that happens.

Liability

FlexHealth is provided "as is", without warranties of any kind. To the fullest extent permitted by South African law, OrganiCode is not liable for any loss or damage arising from your use of the site or the application, including any decision made on the basis of information it displays, any data lost from a device where backup was switched off, and anything done or charged by an AI provider you configured.

Nothing in these terms limits any right you have under the Consumer Protection Act or any other law that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of the Republic of South Africa.
